By accessing or using PinFlywheel ("the Service"), you agree to be bound by these Terms of Service. If you do not agree, do not use the Service.
2. Description of Service
PinFlywheel provides Pinterest marketing tools including keyword research, content optimization, analytics, AI-powered image and copy generation, and account management features. The Service is provided on a subscription basis with different tier levels.
3. Account Registration
- You must provide accurate and complete registration information
- You are responsible for maintaining the security of your account credentials
- You must notify us immediately of any unauthorized access
- You must be at least 18 years old to use the Service
4. Subscription and Billing
- Free tier accounts have limited features and usage quotas
- Paid subscriptions are billed monthly or annually
- You may cancel your subscription at any time; access continues until the end of the billing period
- Refunds are handled on a case-by-case basis within 14 days of purchase
- We reserve the right to change pricing with 30 days notice
5. Acceptable Use
You agree not to:
- Violate Pinterest's Terms of Service or Community Guidelines
- Use the Service for spam, harassment, or illegal purposes
- Attempt to reverse engineer, decompile, or extract source code from the Service
- Share account credentials or allow unauthorized access
- Exceed usage limits or circumvent rate limiting mechanisms
- Use the Service to infringe on intellectual property rights
- Resell or redistribute the Service without authorization
6. Pinterest Account Responsibility
You are solely responsible for your Pinterest accounts and any actions taken through the Service. PinFlywheel provides tools for content optimization and management but does not guarantee specific results, follower growth, or engagement metrics.
7. AI-Generated Content
- AI-generated images and copy are provided as suggestions and starting points
- You are responsible for reviewing and approving all content before publishing
- We do not guarantee that AI-generated content is free from errors or biases
- You retain ownership of content you create using our AI tools
8. Intellectual Property
The Service, including its software, design, and documentation, is owned by PinFlywheel and protected by intellectual property laws. Your subscription grants you a limited, non-exclusive, non-transferable license to use the Service.
9. Data and Privacy
Your use of the Service is also governed by our Privacy Policy. By using the Service, you consent to the collection and use of data as described therein.
10. Service Availability
We strive for high availability but do not guarantee uninterrupted access. We may perform maintenance, updates, or experience downtime. We are not liable for any loss resulting from service interruptions.
11. Limitation of Liability
To the maximum extent permitted by law, PinFlywheel shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or business opportunities, arising from your use of the Service.
12. Indemnification
You agree to indemnify and hold harmless PinFlywheel and its officers, directors, employees, and agents from any claims, damages, or expenses arising from your use of the Service or violation of these Terms.
13. Termination
We may suspend or terminate your account for violations of these Terms or for any other reason with reasonable notice. Upon termination, your right to use the Service ceases immediately.
14. Changes to Terms
We may modify these Terms at any time. Material changes will be communicated via email or in-app notification. Continued use after changes constitutes acceptance.
15. Governing Law
These Terms are governed by the laws of the jurisdiction in which PinFlywheel operates, without regard to conflict of law principles.
